SPESD Board leaves fate of superintendent up in the air

Trustees of the Santa Paula Elementary School Board are looking at possibly reorganizing the District Office.

WilsonSanta Paula TimesTrustees of the Santa Paula Elementary School Board are looking at possibly reorganizing the District Office.Superintendent/CAO Dr. Winston Braham has been out with an undisclosed illness since the start of the school year. The Board has contracted with Dr. Ken Moffett to fill in temporarily in the superintendent’s position and is considering hiring an Assistant Superintendent of Business Services.The future of Braham’s position was left up in the air. Here is the statement read by Board President Tony Perez after a closed session:
“Report of Closed Session – Appointment and classification of Superintendent Winston A. Braham – We coded Mr. Winston A. Braham as a classified manager when hired as an employee on May 1, 2009; the Ventura County Office of Education did not generate a pay hold. Winston should have been coded as a certificated employee with approval by the Board of Trustees under Education Code 35029 to waive the certificated requirements and would have allowed the Santa Paula School District to employ him in the certificated position of Superintendent of the Santa Paula Elementary School District.”Education Code 35029: A local governing board may waive any credential requirement for the chief administrative officer of the school district under its jurisdiction. Any individual serving as the chief administrative officer of a school district who does not hold a credential may be required by the local governing board to pursue a program of in-service training conducted pursuant to guidelines approved by the commission.No individual serving as the chief administrative officer of a school district shall be subject to the provisions of the merit system specified in Article 6 (commencing with Section 45240) of Chapter 5 of Part 25 of this division or any other similar merit system.“A person given a waiver can assign, select and examine certificated employees, but cannot evaluate a certificated employee. Due to the Superintendent’s/CAO absence and after further evaluation, the Board has reviewed the combined position of Superintendent and Chief Administrative Officer, which is beyond the capability of one person and greatly affects the district organization when absent. Therefore, the Board will consider an appointment of an Assistant Superintendent of Business Services and look into the possible reorganization of the District Office.”
