Gang shooting: Valdivia sentenced to life in Zuniga murder

A Santa Paula man was sentenced Tuesday to life in prison with a gang enhancement ensuring that he’ll be released for killing a former city resident outside a Halloween party.

By Peggy KellySanta Paula TimesA Santa Paula man was sentenced Tuesday to life in prison with a gang enhancement ensuring that he’ll be released for killing a former city resident outside a Halloween party.Hector Valdivia, 23, was sentenced to life without parole for the October 27, 2002 street murder of Rusty Zuniga, 25 of Port Hueneme.Valdivia shot Zuniga, a former member of a rival gang, to gain standing in his own gang, according to prosecutors.Valdivia was convicted of the murder in April on charges of first-degree murder with the special circumstance that the crime was committed for the benefit of a street gang. The jury deliberated for four days before returning the verdict.Zuniga was a former gang member who had returned to Santa Paula to visit his grandmother the night he was killed and attended the party around the corner on Cameron Street.
Zuniga was married and had three sons.The trial was marked with changed witness statements and it took another turn when Valdivia’s attorney requested that he be incarcerated in a prison close to his family.Superior Court Judge Donald Coleman said the murder represented “senseless violence,” and noted that state correctional officials will have the final say on where Valdivia is incarcerated.Judge Coleman also mentioned the letters of support that he received from Valdivia’s family but noted that his desire to be an “influential member of the gang” overrode all else.According to his attorney, Valdivia, also a father, was not even in Santa Paula at the time Zuniga was gunned down outside the Halloween party. The gun used in the slaying was never recovered.Valdivia, who has a criminal record and was arrested while in jail on an unrelated charge, did not testify during the trial and made no statement in court after sentencing.
